It would truly be a shame if the initial media blitz around this story obscured later revelations that the facts as first presented had some holes in them.

The Affadavit:

On January 25, 2010, individuals entered and attempted to gain entrance to the office and telephone system of United States Senator Mary Landrieu, located in the Hale Boggs Federal Building, Room 1005, 500 Poydras Street, New Orleans, Louisiana 70130 for the purpose of interfering with the office’s telephone system. The individuals did so by falsely and fraudulently representing that the [sic] were employees of a telephone company.

18 U.S.C. 1036:

(a) Whoever, by any fraud or false pretense, enters or attempts to enter
(1) any real property belonging in whole or in part to, or leased by, the United States;
[…]
shall be punished as provided in subsection (b) of this section.
(b) The punishment for an offense under subsection (a) of this section is –
(1) a fine under this title or imprisonment for not more than 10 years, or both, if the offense is committed with the intent to commit a felony; or
(2) a fine under this title or imprisonment for not more than 6 months, or both, in any other case.

18 U.S.C. 1362:

Whoever willfully or maliciously injures or destroys any of the works, property, or material of any radio, telegraph, telephone or cable, line, station, or system, or other means of communication, operated or controlled by the United States, or used or intended to be used for military or civil defense functions of the United States, whether constructed or in process of construction, or willfully or maliciously interferes in any way with the working or use of any such line, or system, or willfully or maliciously obstructs, hinders, or delays the transmission of any communication over any such line, or system, or attempts or conspires to do such an act, shall be fined under this title or imprisoned not more than ten years, or both.

And, as mentioned before, 18 U.S.C. Sec. 2332b says that this such action is a “Federal crime of terrorism.”

It’s certainly not unheard of to see telephone service men walking around wearing jeans and a jean shirt, mainly because everyone would talk about the giant, walking Levi’s.

Here’s the text of the law you posted:

the term “Federal crime of terrorism” means an offense that
(A) is calculated to influence or affect the conduct of government by intimidation or coercion, or to retaliate against government conduct; and
(B) is a violation of […] 1362 (relating to destruction of communication lines, stations, or systems)

Part B is a given, but I think part A is a stretch. Calculated to influence or affect the conduct of government, maybe, but it looks more like it’s calculated to embarass a particular official and I’m not sure that’s the same thing.

And the prosecutor would also have to prove a motive of doing so by means of intimidation or coercion or retaliation.

Unless one of these dorks has confessed to a plot to, I don’t know, blackmail the Senator or something, I’m not seeing coercion here. I’m definitely not seeing intimidation or retaliation.
